Terms of Service

Welcome to ClimateFunnel. These Terms of Service (“Terms”) govern your access to and use of the ClimateFunnel website, platform, and related services (collectively, the “Service”) operated by ClimateFunnel, Inc. (“we,” “us,” or “our”). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, you may not access or use the Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Service Description

ClimateFunnel is an online platform that connects homeowners seeking HVAC services with licensed, vetted HVAC contractors. ClimateFunnel is a matching and lead generation platform -- we are not an HVAC contractor, and we do not perform any HVAC work ourselves.

We facilitate introductions between homeowners and contractors but are not a party to any agreement between them. The quality, timing, pricing, and completion of HVAC services are solely the responsibility of the contractor.

3. User Accounts & Registration

Certain features of the Service require an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. For Homeowners

• Free service: ClimateFunnel is completely free for homeowners. There is no fee to submit a quote request or to be matched with a contractor.
• Lead submission: When you submit a quote request, your contact information and service details are shared with matched contractors so they can reach out to you.
• No guarantee of match: While we strive to match every request, we cannot guarantee that a contractor will be available for your specific location, service type, or timeline.
• No endorsement: Matching you with a contractor does not constitute an endorsement or guarantee of their work. You should independently verify any contractor before hiring.

5. For Contractors

Pay-Per-Qualified-Call Model

ClimateFunnel operates on a pay-per-qualified-call basis. Contractors are charged only when a homeowner connects with them through the ClimateFunnel platform and the connected call duration meets or exceeds the 60-second minimum threshold. Calls shorter than 60 seconds are not billed.

ClimateFunnel does not guarantee closed deals, booked jobs, signed contracts, or revenue of any kind. We deliver qualified call connections — what happens after the call is entirely between you and the homeowner.

Call Recording & Tracking

All calls facilitated through the ClimateFunnel platform may be recorded and tracked for quality assurance, billing verification, and fraud detection purposes. By registering as a contractor and using the Service, you consent to such recording and tracking. Homeowners are notified of call recording prior to connection in all jurisdictions where required by applicable law. Call recordings are retained for up to 90 days and may be used to resolve billing disputes.

Call Pricing

Per-call pricing varies by service type, geographic location, competition level, and plan tier. Current pricing is displayed in your contractor dashboard and may be updated with 30 days' notice. Pricing generally falls within the following ranges:

• Starter: $20–$30 per qualified call (shared with up to 3 contractors)
• Standard: $30–$45 per qualified call (shared with up to 2 contractors)
• Premium Exclusive: $50+ per qualified call (delivered exclusively to you)

These ranges are estimates only. Actual per-call prices are set at the time of delivery and confirmed in your dashboard. Contact us for current rates in your service area.

Payment Terms

Qualified calls (60+ seconds connected) are billed automatically via Stripe upon meeting the duration threshold. Contractors must maintain a valid payment method on file at all times. Accounts with failed payments will have lead delivery paused until the outstanding balance is resolved. ClimateFunnel reserves the right to charge any valid payment method on file for outstanding balances.

Credit System

New contractors may receive promotional call credits as part of their onboarding package. Credits are applied automatically to qualifying calls, are non-transferable, have no cash value, and expire after 90 days if unused. Promotional credits cannot be exchanged for cash or applied to existing balances.

Dispute & Refund Policy

Contractors may dispute a billed call within 3–5 business days of the charge. Dispute requests submitted after this window will not be considered. Eligible dispute reasons include:

• Call duration was falsely reported or technically miscalculated
• The homeowner's contact information was invalid, fictitious, or disconnected
• The call was a verifiable duplicate of a previously billed call for the same service request
• The homeowner's service address was outside your registered service area at the time of delivery

Disputes must be submitted through your contractor dashboard or by emailing support@climatefunnel.com with the call ID, date, and reason. Approved refunds are issued as account credits within 5 business days of approval. ClimateFunnel's decision on disputes is final.

Fraud Protection

ClimateFunnel employs automated and manual fraud detection systems to identify and filter invalid or manipulated calls. Contractors who engage in call fraud — including but not limited to generating artificial call traffic, manipulating call duration to meet the billing threshold, or colluding with homeowners to inflate billable calls — will be permanently removed from the platform. ClimateFunnel reserves the right to reverse all credits obtained through fraudulent activity and to pursue legal remedies to recover damages.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to any part of the Service or its systems
• Scrape, crawl, or use automated tools to extract data from the platform
• Circumvent the platform to avoid lead fees (e.g., soliciting direct contact with homeowners outside the platform before accepting the lead)
• Harass, abuse, or harm another user of the Service
• Interfere with or disrupt the Service or servers

7. Intellectual Property

The Service, including its design, text, graphics, logos, icons, images, code, and software, is the property of ClimateFunnel, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the quality, accuracy, or reliability of any HVAC services provided by contractors matched through our platform.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIMATEFUNNEL, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you have paid to ClimateFunnel in the 12 months preceding the claim, or (b) $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless ClimateFunnel, Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including ownership provisions, warranty disclaimers, and limitations of liability) will survive.

You may terminate your account at any time by contacting us at support@climatefunnel.com. Contractors with outstanding balances must resolve them before account closure.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts.
